The Committee on Finance moves to amend the bill on page one, section thirteen-a, beginning on line one, by striking out the remainder of the bill and inserting in lieu thereof the following:
"(a) In addition to the requirements of section thirteen of this article, a municipality that imposes or increases by ordinance any rate, fee or charge for the installation, continuance, maintenance or improvement of any essential or special municipal service pursuant to said section thirteen shall, in the ordinance:
(1) Set forth the specific purpose or purposes for which the rate, fee or charge is imposed or increased;
(2) Establish a municipal special revenue account separate and apart from the municipality's general revenue account to be administered by the municipality solely for the specific purpose or purposes for which the rate, fee or charge is imposed or increased;
(3) Require that all collections of the rate, fee or charge shall be deposited into the municipal special revenue account and may be expended only for the specific purpose or purposes for which the rate, fee or charge is imposed or increased; and
(4) Prohibit the transfer or deposit of any of the collections or any of the moneys in the municipal special revenue account into the municipality's general revenue account.
(b) No provision of this section applies to any ordinance in effect on the effective date of the enactment of this section, except that this section shall apply to an ordinance in effect on the effective date of the enactment of this section if it is subsequently amended to increase the rate, fee or charge imposed by the ordinance.".
